Punishments of Marijuana use in New Mexico:
Possession of 1 oz or less (first offense) is a misdemeanor, punishable by 15 days in jail and a $50-100 fine. Subsequent offenders may see a year in jail and 1,000 fine.
Possession of 1 to 8 oz is a misdemeanor, punishable by 1 year in jail and up to a $1,000 fine.
Possession of 8 oz or more is a felony, punishable by 18 months in jail and a $5,000 fine.
Distributing or cultivating 100 lbs or less (first offense) is a felony, punishable by 18 months in jail and a $5,000 fine. Subsequent offenses may get 3 years in prison.
Distributing or cultivating more than 100 lbs (first offense) is a felony, punishable by 3 years in prison and a $5,000 fine. Subsequent offense will get 9 years in prison and a $10,000 fine.
Distributing any amount to a minor (first offense) is a felony, punishable by 3 years in prison and a $5,000 fine. Subsequent offenses are punishable by 9 years in prison and a $10,000 fine.
Distributing 100 lbs or less within a school zone (first offense) is a felony, punishable by 3 years in prison and a $5,000 fine. Subsequent offenses are punishable by 9 years in prison and a $10,000 fine. If more than 100 lbs the punishment almost doubles.
