Pennsylvania has not decriminalized marijuana like several other states have. Nor do they recognize it legally to treat certain medical conditions. In other words, if you are caught possession, growing, or selling marijuana, you will face criminal charges.
Possession of 30 grams or less is a misdemeanor, punishable by 30 days in jail and a $500 fine.
Possession of more than 30 grams is a misdemeanor, punishable by 1 year in jail and a $5,000 fine.
There is possible probation for the first possession offense. Any second or subsequent convictions can double the penalties.
Distributing up to 30 grams for no compensation is a misdemeanor, punishable by up to 30 days in jail and a $500 fine.
Distributing less than 1,000 lbs is a felony, punishable by 1-3 years in prison and a $5,000 - $25,000 fine.
Distributing more than 1,000 lbs is a felony, punishable by 10 years in prison and a $100,000 fine.
Growing 10 - 21 plants or 2 - 10 lbs results in a year in jail $5,000 fine.
Having 21 to 51 plants (10 - 50 lbs) results in a minimum of 3 years in prison and a $15,000 fine.
Probation is possible for first offenders.
Possession of marijuana within 1,000 ft of a school or within 250 ft of a playground is punishable by 2-4 years in prison.
